Mr Wilson was not qualified to stand for election or be elected because, before the election, he had been convicted in the Northern Territory Court of Summary Jurisdiction of unlawful assault accompanied by circumstances of aggravation and sentenced to imprisonment for 12 months, and no exception in s 102(2) applied. Because he was incapable of being chosen, he was not duly elected. A fresh election, rather than a special count of Mr Wilson's preferences, was required because the Court was not satisfied that distributing his preferences would probably represent the will of the electorate had he not been a candidate.
