Although Yong's unilateral withdrawal of the statutory demand gave Canon substantial practical success, Canon had not shown Yong a sufficiently particularised genuine dispute or offsetting claim until its memorandum was filed on 2 July 2009. Up to that date Yong reasonably maintained that no bona fide dispute was self-evident. After that date Canon would have had a stronger claim to costs, but Yong's 24 July 2009 offer to withdraw the demand and discontinue on a no-costs basis was not less favourable than the result otherwise appropriate, and later costs could have been avoided by accepting it.
