The appeal was dismissed because, except for the overall RL 195 height requirement, the proposal breached almost all of the council's numerical planning controls concerning scale, height and bulk, breached qualitative controls directed to a harmonious relationship between streets and buildings, caused unacceptable overshadowing to bedrooms in the Century Plaza building and view impacts from some dwellings in 79-81 Berry Street, and was overdevelopment of the site. The SEPP 1 objections were not well founded, the building height plane breach was unacceptable, and the appropriate maximum height was accepted to be RL 103m rather than the proposed RL 162.50m.
