Procedural Posture
Application to Set Aside Creditor's Statutory Demand / Principal Judgment on Originating Process Filed 26 October 2022
Legal Issues
- 1 ["Whether there was a genuine dispute about the existence or amount of the debt claimed in the creditor's statutory demand." 'Whether the Defendant could support the statutory demand on a basis other than the debt described in the demand and accompanying affidavit.' 'Whether the statutory demand should be set aside under the Corporations Act 2001 (Cth).']
Ratio Decidendi
The evidence made it plainly arguable that a collateral agreement, practice, or representations capable of giving rise to conventional, promissory or representational estoppel prevented reliance on the lease according to its stated rent terms, creating a genuine dispute about the amount claimed in the demand. Mr Fraser could not support the statutory demand by substituting a different debt calculated by reference to mortgage payments, and such an approach would mean the demand did not properly describe the debt claimed. The demand was therefore set aside.
Court Disposition
Creditor's statutory demand set aside, with the Defendant to pay the costs of the proceedings.
Orders
- ['The statutory demand dated 5 October 2022 served on Cat and Dog Hotel Pty Ltd by Mr Fraser be set aside.' 'Mr Fraser pay the costs of the proceedings as agreed or as assessed.']
