The proceeding was dismissed because the applicant failed to appear at the hearing, failed to comply with orders requiring evidence and submissions to substantiate her claim, and failed to prosecute the proceeding with appropriate diligence. The purported adjournment request was not a proper application and was unsupported by medical evidence. The Court was also satisfied there was no cogent evidence that Paul Ribbera's interest as joint tenant was less than an equal share, and bankruptcy severed the joint tenancy in equity so that the trustee was entitled to an equal share.
