The appellant's QCAT claim sought only payment of money for alleged direct pecuniary loss, namely recovery of commission retained by Mint Property. That claim was a debt claim and a chose in action, constituting property that vested in the trustee and was divisible among creditors. It was not a personal injury or wrong within s 60(4) of the Bankruptcy Act 1966 (Cth), and Griffiths was distinguishable because the present proceeding could affect the value of the bankrupt estate and the chose in action was assignable. The trustee was therefore entitled to elect under s 60(2) to discontinue the QCAT proceeding, and the primary judge's reasons were adequate.
