The findings by Darke J that Champion's acknowledged debt was truly owing and that a valid equitable charge was created by the Letter of Acknowledgement of Debt were legally indispensable to the declaration that Champion's interest had first priority. Those findings created an issue estoppel preventing JKAM from contending that no money was owing under the Letter. Champion was therefore primarily entitled to the sum paid into Court and had priority over the other potential claimants.
