Those circumstances included the appellants commencing and varying claims above and below jurisdictional thresholds, being on notice of the limitation issue, pursuing a claim ultimately outside the Tribunal limitation period, serving extensive largely irrelevant material, and otherwise causing unnecessary costs. No ground challenged the lump sum basis of the order, so the costs order of $20,987.51 was not disturbed and the appeal was dismissed.
