Taylor v Mosman Council [2005] NSWLEC 233
The garage was allowed in principle because a see-through carport would provide a very low level of security, Iluka Road contained numerous garages and no carports, and requiring a carport on this single property would not make much difference to street views; however, the garage was to be narrowed to an internal width of 6m. The ridge height was required to be lowered by 500mm because the height template showed that the reduction would retain the view of the shoreline for pedestrians, the applicant's justification for a 35-degree pitch was not accepted, and the reduction preserved an important segment of public view without imposing a burden on the applicant.
