The Guarantee given by Mrs Flynn was only in relation to obligations incurred as trustee of The Flynn Discretionary Trust; after the Trust vested and ceased to exist, no obligations could be incurred by the Company as trustee for the Trust. Therefore, the Guarantee is void as an ineffective means for CHEP to recover the debt. Further, even if the Guarantee were enforceable, CHEP failed to satisfactorily prove the quantum of its claimed loss, and a significant portion of the claim involved unrecoverable penalties.
