Chow Hung Ching v R [1948] HCA 37

The High Court held that (1) under the Papua-New Guinea Provisional Administration Act 1945-1946, the appeal lay as of right, and (2) on the facts, the appellants were not members of an armed force of the Republic of China but were civilian labourers subject to some military discipline. Accordingly, they were not immune from local criminal jurisdiction, and the Supreme Court of the Territory had jurisdiction to try and convict them.
