The State proved that SC Owen suspected on reasonable grounds that Mr Dennis had committed offences and that SC Owen in fact held a state of satisfaction that arrest was reasonably necessary to prevent further offences, protect public safety and because of the nature and seriousness of the suspected offences. However, that state of satisfaction and decision to arrest were vitiated because there were many obvious alternatives short of arrest that would have met SC Owen's stated concern, and the failure to properly consider and weigh those alternatives made the decision capricious, irrational, arbitrary or manifestly unreasonable.
