Adamson v Ede [2008] NSWSC 1184

Adamson v Ede [2008] NSWSC 1184

The Court refused to stay enforcement because it was not satisfied that the dealings between the parties could safely be reduced to the proposition that the plaintiff owed the defendant more than the defendant owed the plaintiff. The alleged debts and costs claims were uncertain, substantially unassessed, disputed, strategically affected by an assignment obtained after judgment, and embedded in extensive acrimonious litigation. Justice did not require staying enforcement of a final defamation judgment not under appeal, and the same reasoning defeated the applications to set aside the charging and examination orders.

Ratio Decidendi

The Court refused to stay enforcement because it was not satisfied that the dealings between the parties could safely be reduced to the proposition that the plaintiff owed the defendant more than the defendant owed the plaintiff. The alleged debts and costs claims were uncertain, substantially unassessed, disputed, strategically affected by an assignment obtained after judgment, and embedded in extensive acrimonious litigation. Justice did not require staying enforcement of a final defamation judgment not under appeal, and the same reasoning defeated the applications to set aside the charging and examination orders.
