Appeal / Judgment – Orders and Reasons

  1. 1 ['Whether the appellants materially departed from their pleaded case in final submissions regarding quantification of loss' 'Whether the appellants proved entitlement to damages based on payment schedules issued by the builder and amounts paid to them' 'Whether payment schedules are sufficient evidence of debts owing under subcontracts']

Ratio Decidendi

The appellants' case as to damages was not materially changed from that pleaded; the calculation based on payment schedules minus amounts paid was always open on the pleadings and trial evidence. The primary judge erred in rejecting the sufficiency of this evidence and dismissing the claims.
