Because the evidence showed that Jean Koerstz's original will was destroyed after her death by a person other than the testatrix and a photocopy of the will with signatures was available, there was no realistic prospect of the original being produced and the proper probate practice would have been an unlimited grant. In any event, the limited grant did not deprive the defendant of ordinary administrative powers, and s 40D of the Wills, Probate & Administration Act 1898 would protect the administrator if the grant were later revoked; therefore the defendant had full power to act as administratrix, including to compromise the proceedings.

Court Disposition

The defendant has full power to act as administratrix of Jean Koerstz's estate, including the power to compromise the suit.
