Comcare v Smith, Graham Scott [1996] FCA 432
The appeal failed because there was evidence on which the Tribunal could find that the respondent's Army service aggravated his reflux oesophagitis and that the effects of that aggravation continued after 2 August 1993. The Tribunal was entitled to accept the respondent's unchallenged oral evidence of continuing symptoms, which was supported by medical certificates and the 21 September 1994 endoscopy report, despite contrary opinions from Dr Falk. The Tribunal addressed the causation issue, gave adequate reasons, and did not rely on earlier compensation payments as proof of liability but expressed concurrence that acceptance of liability for earlier periods was appropriate on the evidence.
