Given that the scheme does not alter CMLA policyholders’ benefits, multiple actuaries found no prejudice to those policyholders, APRA did not object, and policyholders were informed via press notices, it is not necessary in this case to provide an approved summary to every CMLA policyholder. For CLL policyholders with no current mailing address, dispensation is appropriate as tracing them is impractical.

  • Pursuant to s 191(5) Life Insurance Act 1995 (Cth), requirements of s 191(2)(c) are dispensed with insofar as it requires an approved summary of the scheme to be given to holders of policies issued by CMLA and holders of CLL policies for whom no current mailing address exists.
  • Requirements of s 191(2)(c) are also dispensed with as regards holders of CLL policies issued on or after 17 March 2003, in respect of the requirement for 15 days' notice prior to filing the application.
