Conceal Pty Ltd v Wingecarribee Shire Council [2005] NSWLEC 49
The appeal failed because the proposed 13 lot subdivision was premature and an overdevelopment of a constrained, flood-liable site. Although access via Meryla Road was not a sufficient reason for refusal, the magnitude and interim nature of the required drainage diversion, filling, swales, retaining structures, works on council land and future reinstatement costs would adversely affect landscape, scenic quality and residential amenity, raise public interest and maintenance concerns, and fail to satisfy the Residential 2(a) zone objectives and cl 51 of the Wingecarribee Local Environmental Plan 1989.
