PARKER v NOMINAL DEFENDANT [2007] NSWDC 40

PARKER v NOMINAL DEFENDANT [2007] NSWDC 40

The oil spill was sufficient to create a hazard requiring absorbent treatment, was located where vehicles stopped at traffic lights, and was large enough to support the inference that it leaked from a motor vehicle waiting for up to two minutes. Those facts made the leak out of the ordinary and supported the most reasonable inference that it resulted from negligent maintenance or failure to remedy an observable leak. The plaintiff therefore proved liability, and damages were assessed according to the accepted evidence of her injuries, ongoing limitations and needs.
