The Court found that leave should be granted to the liquidator to distribute surplus assets of the trust to unitholders, as the assets were held for the trust beneficiaries and all relevant parties consented. It was proper to dispense with the requirement for a formal schedule of persons entitled, and for directions to the liquidator as to appointment of a vesting date and termination of the trust in accordance with the trust deed. The liquidator's costs should be paid out of the Company's assets.
