Because the Plaintiff did not disclose in his Statement of Affairs any debt or property corresponding to the claim, s 129AA did not operate to re-vest that property in him on discharge from bankruptcy. Any such claim remained vested in the trustee in bankruptcy, so the Plaintiff had no standing to bring or maintain the proceedings. The proceedings therefore disclosed no reasonable cause of action and were an abuse of process under r 13.1 UCPR.
