Data Access Corporation v Powerflex Services Pty Ltd & Ors [1996] FCA 38
Most of the words of the DataFlex computer language adopted in PFXplus, and related elements such as Huffman Compression Table and function key labels, are not dictated by functionality or obviousness, go beyond mere ideas, and are original and substantial enough to be copyrightable expressions; adaptation in PFXplus constituted infringing adaptations or reproductions. Elements such as the error text table, if only expressing an idea inseparable from its function, or reproduced in insubstantial part, would not be protected. There was no implied licence, estoppel, or laches preventing enforcement. The parties would be heard further as to individual liability and precise orders.
