Procedural Posture

Bankruptcy Appeal / Appeal From a Single Judge of the Federal Court of Australia Against a Sequestration Order

  1. 1 ['Whether the bankruptcy notice was a nullity because paragraph 1 omitted the amount of the debt while referring to the Schedule where the amount was stated.' 'Whether the omission was a failure to comply with an essential requirement of the bankruptcy legislation or a formal defect or irregularity cured by s 306 of the Bankruptcy Act 1966 (Cth).']

Ratio Decidendi

The bankruptcy notice, read as a whole, clearly and unambiguously informed the debtor that the creditor claimed $300,000: the Schedule stated $300,000 as both the judgment amount and total debt owing, and the attached Supreme Court judgment also stated judgment for $300,000. The omission of the figure from paragraph 1 was therefore not a failure to comply with an essential requirement but only a formal defect or irregularity. As no substantial injustice was shown, s 306 of the Bankruptcy Act 1966 (Cth) applied and the notice was not invalid.

Court Disposition

Appeal dismissed with costs.
