Parker v The Queen [1997] HCA 15

Parker v The Queen [1997] HCA 15

The High Court held that the trial miscarried owing to legal misdirection and error by the Court of Criminal Appeal, particularly in introducing equitable tracing principles and statutory trust concepts not found in the Code. It would be unfair to permit retrial on a different basis from the original trial, and the evidence as presented could not justify a new trial. In the circumstances, verdicts of acquittal must be entered.
