Ratio Decidendi

The applicant's unpaid administrative fund contributions must be satisfied by transfer from his surplus in the capital works fund, with any remaining surplus refunded. No interest is payable due to the owners corporation's accounting and communication failures and failure to provide account statements. The resolutions of the AGM remain valid as the applicant was unfinancial at that time per the Act; however, only one co-owner of a lot may be a member of the strata committee, so one must resign, or Mr Andrews will be removed if neither does so within 14 days. No order is made regarding additional levies for maintenance as no such levy was actually imposed.
