Because the Club's adopted rules did not provide for resolution of disputes between members or between members and the Club, model rule 10 was deemed by s 19(3) of the Associations Incorporation Act 1984 to be included in the Club's rules. By s 11(2), that rule had contractual force between the association and its members. The dispute therefore had to be referred to mediation in accordance with model rule 10 before the proceedings continued, making a stay appropriate but not a strike out.
