Although the trustee stood in no better position than Mr Greaves for the purposes of the stay application, CGU failed to establish that the present proceedings were on the same or substantially the same cause of action as the prior proceedings. The prior proceedings sought payment of defence costs under an extension of the policy, whereas the present proceedings sought indemnity for a $20 million compensation order under a different policy response to a different risk, with the making of the compensation order being an essential element that had not occurred in the prior proceedings.
