Although genital neisseria gonorrhea in a pre-pubertal girl usually indicates sexual interference and justified prompt intervention, the evidence did not prove to the required standard that D W sexually interfered with M W. Expert evidence established that, if the right conditions exist, non-sexual transmission by transfer of viable inoculum to a mucosal surface can occur, and towelling after bathing was a realistic possibility despite being remote. Given the seriousness of the allegation, the Briginshaw considerations and s140 of the Evidence Act, the Department's case for continuing intervention was not made out on the balance of probabilities.
