Morgan was convicted by jury verdict of detaining a victim for advantage in company with intent to intimidate, occasioning actual bodily harm. The offence was planned to some degree; violence and intimidation were used. While Morgan's mental health and drug abuse, as well as personal circumstances, were acknowledged and warranted some leniency, only a sentence of full-time imprisonment could properly reflect the gravity of the offence, the harm done to the victim, and the purposes of sentencing, including general deterrence and parity with co-offenders. No further discount was available as Morgan did not plead guilty.
