The appeal was dismissed because Pt 4 of North Sydney Local Environmental Plan 2001 applied and prevailed over the savings provision in sub-cl 5(3); applying the heritage criteria in cl 48, the listed terrace houses were the last surviving late Victorian terraces in Alfred Street, retained sufficient fabric for conservation, were structurally sound and should be conserved and maintained rather than demolished. In any event, the replacement building should not be approved because it materially exceeded floor space ratio, height, storey and building height plane controls and would create unacceptable amenity impacts, including poor internal amenity and impacts on surrounding occupiers.
