Ratio Decidendi

The Local Court erred in law by misinterpreting the sequence and effect of contractual documents (Deed of Surrender, 2010 lease, Fuel Reselling Agreement), leading to incorrect findings about ownership of certain fixtures and chattels. The Deed of Surrender was not the later document and did not disclaim Dib's ownership of tenant's removable fixtures, which remained governed by the terms of subsequent agreements. The Local Court also erred in law regarding the conversion claim relating to the price board and support structure, due to unsupported factual findings. These errors warrant setting aside the Local Court orders and remitting the matter for redetermination.
