On inspection of the 69 documents and on the uncontested affidavit evidence, each document fell within paragraph 3(a) of the 11 September 2014 order and in substance attracted both advice privilege and litigation privilege. Any waiver arising from the compromise and/or estoppel pleas was confined to pleaded or associated communications with Mr Graer and did not extend to any of the 69 documents. Production for inspection was therefore refused.
