Renton v Repatriation Commission (No 2) [2009] FCA 792

Renton v Repatriation Commission (No 2) [2009] FCA 792

Although errors in the AAT's reasoning had been identified, the AAT's findings that the onset of the applicant's alcohol dependence pre-dated his war service and that there was no evidence of aggravation were fatal to the applicant's case and were not open to challenge on the appeal. The appropriate order under s 44(4) of the Administrative Appeals Tribunal Act 1975 (Cth) was therefore dismissal of the appeal with no order as to costs.
