Procedural Posture

Appeal / Decision of Appeal Panel

  1. 1 ['Whether the application to amend Rule 18 and claim compensation was brought out of time' 'Whether the Tribunal had power to order making or amendment of village rules' 'Whether the Appellant was entitled to compensation for alleged breach of peace and enjoyment under s 66 of the RV Act']

Ratio Decidendi

The Tribunal at first instance erred in concluding that applications under s 54 or s 128 RV Act were out of time, as such applications may be made at any time. However, the Tribunal did not err in dismissing the substantive applications: Rule 18 cannot be construed to allow unfettered smoking, the Tribunal cannot create new rules or amend rules without the prescribed resident approval, and compensation was properly refused due to insufficient medical evidence and limitations of the Civil Liability Act.
