Sims v Chong [2015] FCAFC 80
The Full Court held that it was arguable on the material before the primary judge that the appellant's claims (including those based on alleged misrepresentation and failure to advise on potential causes of action outside contract) did not clearly fall within the scope of advocate's immunity as established by the existing High Court authority, particularly in circumstances where the underlying litigation had been dismissed at an interlocutory stage (not after a final hearing), and where some claims related to conduct occurring before litigation commenced or to statutory causes of action whose immunity coverage was not clearly established. Therefore, summary dismissal was not warranted.
