The subject drawings were original artistic works in which copyright subsisted, and the applicant owned the copyright by assignment from Eagle Management. Although aspects of the respondent's "Paterson" plan were derived in part from "The Kookaburra", the subject drawings had no feature of marked originality; many similarities reflected commonplace project home design features, and there were significant differences in layout, dimensions and room relationships. The applicant therefore failed to prove that the "Paterson" advertisement or the admitted "Paterson" and "Robertson" homes reproduced a substantial part of the subject drawings.
