Upon finding that actual copying of the Kookaburra plans by the respondent occurred, and considering the objective similarities that resulted, the Full Court held that Austec's Paterson plan reproduced the Kookaburra plan as a whole or, at least, a substantial part of it. The trial judge erred by requiring an especially close resemblance and by giving excessive weight to the lack of marked originality and the commonplace features of project home plans, rather than focusing on whether the essential features and substance of the Kookaburra plans were reproduced in the Paterson. The appeal was allowed and the orders below set aside.
