Easterbrook v Young [1977] HCA 16

Easterbrook v Young [1977] HCA 16

The Court held that jurisdiction exists under the Act to extend time for an application for maintenance unless the whole estate has been physically distributed by the personal representative to the beneficiaries. The appellant was left without adequate provision for maintenance, and nothing less than absolute ownership of the property would constitute adequate provision. Appeal allowed, time extended, and entire interest in the real estate vested in the appellant.
