The hearing before the Senior Deputy President was not 'fair and just' because permission for Bacto Laboratories to be represented by a lawyer was granted without any apparent consideration of or findings concerning the requirements of s 596(2) of the Fair Work Act 2009 (Cth), which resulted in disadvantage to Mr Warrell. The Full Bench erred in not recognising that the initial hearing lacked fairness as required by s 577(a).
