EII v Children’s Guardian [2021] NSWCATAD 4
Having regard to the applicant being acquitted of all charges, the absence of further criminal history or misconduct, the circumstances of the allegations and doubts about the child's evidence, and the psychologist's risk assessment indicating a low risk of reoffending, the Tribunal was satisfied that a reasonable person would allow their child unsupervised contact with the applicant and it was in the public interest to grant the clearance. The Tribunal therefore set aside the respondent’s decision and granted the clearance.
