The Commission determined that the applicant did not unreasonably fail to settle within the meaning of s181(2)(c) of the Act, based on a review of the negotiation process and the reasons for each party's position. Both parties moved towards settlement and maintained positions justified by their understanding of their case and commercial interests. Failure to reach agreement was not, in itself, unreasonable, nor could failure in arbitration be taken as evidence of unreasonable conduct in the conciliation process. Accordingly, an award of costs was not appropriate.
