Procedural Posture

Appeal / Determination of Costs Post Appeal

  1. 1 ['How should costs be apportioned at first instance and on appeal following a different outcome on appeal, particularly where parties enjoyed partial success on discrete issues?']

Ratio Decidendi

The party ultimately successful in the claim (Mr Kumaran and ELMO) is entitled to costs, subject to an appropriate reduction for issues upon which they were unsuccessful. Employsure is ordered to pay 65 per cent of their costs at first instance, as the competition issue was a discrete and significant matter on which Employsure succeeded, justifying reduction. On appeal, as Employsure conceded, costs follow the event, but are not to include costs referable to the 'protectable interest' issue.

Court Disposition

Costs orders made as specified: Employsure to pay 65% of appellants' costs at first instance; Employsure to pay appellants' costs of the appeal excluding costs referable to the 'protectable interest' issue.

Orders

  • ["The plaintiff pay 65 per cent of the defendants' costs of the proceedings at first instance as agreed or assessed." "The respondent to pay the appellants' costs of the appeal as agreed or assessed." "Order (2) does not include any costs in this appeal referable to the 'protectable interest' issue."]
