Wilson v Commonwealth of Australia [1999] FCA 1754
Although Einfeld J had no independent recollection of the 1994 matter, the earlier Full Court judgment in which he joined contained adverse comments about Mr Wilson's evidence, and Mr Wilson's credibility was again raised in the current appeal. A reasonably objective bystander armed with the current judgment under appeal and the 1994 Full Court judgment might apprehend that Einfeld J could not bring a wholly dispassionate and unbiased mind to the appeal, so he disqualified himself.
