Powell v Aymkone Pty Limited [2009] NSWSC 103

The court found that the plaintiff did not prove on the balance of probabilities that he ever gave any direct instructions to Mr Pooley, or that Mr Pooley or Aymkone had notice that Mr Powell was the true beneficial owner of the funds. The defendants' dealings were in good faith and for value, and without such notice they are not liable in equity to the plaintiff for breach of trust regarding the monies in question.
