Section 93(1) of the Veterans' Affairs Legislation Amendment Act 1990 did not allow the applicant to rely on the former s 5B(2) definition of "allotted for duty" for his 1996 service pension claim, because that provision does not extend the old definition to claims or applications not granted on or before 8 November 1990. The Tribunal therefore did not err in holding that s 93(1) did not establish the applicant's qualifying service for service pension eligibility, and the estoppel or preclusion argument was rejected.
