Europa failed to prove that Mr Child or Ms Reddy signed confidentiality deeds, so its contractual claim failed. Its manufacturing method for aromatic bitters was not confidential information but know-how forming part of Mr Child's general skill, knowledge and experience. The recipe and licence information were adequately protected by the defendants' undertakings to the Court, and although certain financial documents were confidential, there was no evidence of actual or threatened misuse or justification for further relief. Europa therefore did not establish a case for protection in contract or equity beyond the existing undertakings.
