Because the plaintiff's prospects of obtaining probate of the document dated 22 February 2002 were not strong, and his prospects of establishing entitlement to administration based on the 13 June 2003 marriage were very poor, the Court refused the plaintiff's requested declaration. In the absence of another person claiming to conduct estate affairs, the defendant, as closest blood relative and a potential claimant for administration, was directed to arrange the funeral and lawful disposition of the deceased's body.
