The Federal Magistrate did not err in finding that the appellant engaged in misleading or deceptive conduct. In the circumstances of an expensive new demonstrator vehicle sold in October 2001, with documentation not indicating that it was a 2000 model, and with a current 2001 model having significantly greater trade-in and depreciated value, the respondent reasonably understood it was purchasing the current 2001 model. The appellant's failure to disclose that the vehicle was in fact a 2000 model was therefore misleading or deceptive, and the inferences drawn by the Federal Magistrate were reasonably available.
