Procedural Posture

Class 1 Appeal Under S97 of the Environmental Planning and Assessment Act 1979 Against Refusal of a Development Application / Merits Determination After Hearing

  1. 1 ['Whether the proposed Bio-clinic Facility was consistent with the relevant objectives of Zone No 1(a) Rural General under the Greater Taree Local Environmental Plan 1995.' 'Whether insufficient information about vegetation clearing, asset protection zones, emergency access and landscaping prevented assessment of consistency with the relevant zone objectives.' 'Whether the development was appropriate in a rural location and sympathetic with the environmental characteristics of the land.' 'Whether visual impacts from Saltwater Road, the residential headland, the National Park and Nature Reserve were adequately assessed.' 'Whether Aboriginal cultural heritage assessment was sufficient.']

Ratio Decidendi

The development was refused because it was not consistent with the relevant objectives of the 1(a) Rural General Zone, including objectives (a) and (d), and the relevant General Rural Zone objective in cl 12(c). The absence of final landscaping, clearing and bushfire access detail made it impossible to assess whether the built form and required asset protection zones would protect or conserve environmental values, visual amenity, landscape and scenic quality, rural character and tourism values, or whether the development was appropriate in a rural location and sympathetic with the environmental characteristics of the land. The proposal was therefore not permissible in the zone.

Court Disposition

Appeal dismissed; development application refused.
