The 2002 lease, on its proper construction, incorporated by reference the rights in Annexure C of the 1997 lease due to the language used, the surrounding circumstances, the factual matrix, and visible occupation and signage of the car parking spaces. If this were incorrect, rectification would have been ordered as Nasser Holdings, not being a registered proprietor and having notice, was bound by Mr Young’s equity for rectification.
